ECJ: Flights that have been moved forward are considered to be canceled

Travelers are entitled to compensation even if their flight was brought forward by more than an hour. This was decided by the European Court of Justice. A flight is considered cancelled if it is brought forward by more than an hour. This means that passengers are entitled to compensation. Bringing a flight forward in this way is significant because it can cause serious inconvenience for passengers, argued the European Court of Justice in a ruling published today. Passengers can then no longer freely use their time - for example because they have to make great efforts to get to the airport on time. A passenger can have claims against an airline even if the travel company they commissioned did not actually book the flight, according to the highest European court. If the tour operator has issued a receipt for the flight, this receipt is considered a confirmed booking. The passenger cannot be required to obtain information about the relationships between the companies. Several Austrian and German passengers had filed suit. Following the decision from Luxembourg, the national courts - in Germany the Düsseldorf Regional Court - must now decide the specific cases. Passengers are generally entitled to compensation if their flight is cancelled. An airline may refuse payment – which is between 250 and 600 euros depending on the distance – only in a few exceptional cases, such as if the passenger is informed of the cancellation at least two weeks before departure or if an “extraordinary circumstance” can be proven. The published ruling of the ECJ makes it clear that a flight that is delayed by more than

Air Baltic: EU Commission approves government funding

Yesterday, the European Commission approved part of the Latvian government's €45 million investment in the airline's equity in accordance with EU state aid rules. This financial injection is necessary to offset the losses caused by the ongoing Covid-19 pandemic. "The support of our majority shareholder in overcoming the crisis reflects recognition of Air Baltic's positive impact on the economy. The European Commission has concluded that the COVID-19 pandemic is such an exceptional event that exceptional interventions by Member States to compensate for the associated damage are justified," explains airline CEO Martin Gauss. The government wants to release a total of €90 million for the carrier. The second part of the investment is still subject to approval by the European Commission.

“Mixed demand”: Austrian Airlines suspends further routes

The airline Austrian Airlines is currently struggling with weak demand on some routes. As a result, further routes are being temporarily suspended. Affected are, for example, Cologne/Bonn, Sibiu, Manchester, but also Tehran and Montreal. A few weeks ago, Aviation.Direct reported that the Lufthansa subsidiary would temporarily suspend flights to Bologna, Leipzig, Nuremberg and Zaporizhia. Austrian Airlines has now confirmed that Cologne/Bonn, Sibiu, Manchester, Palma de Mallorca, Tehran and Montreal are also affected. The routes, if they are still being served, are to be suspended from the third calendar week of 2022. A company spokeswoman said: “Unfortunately, due to the mixed pandemic and booking situation, we have had to reduce our original flight schedule for primarily the period weeks 3-8. This affects the intercontinental routes VIE-YUL and VIE-IKA, and the continental routes VIE-BLQ, VIE-CGN, VIE -OZH, VIE-SBZ, VIE-NUE/LEJ, VIE-MAN and VIE-PMI". However, the cuts at Austrian Airlines are not an "isolated case", as competitor Wizz Air has also reduced its services from Vienna-Schwechat. New additions such as Amman and Aqaba were not implemented at short notice. 12 routes from Austria's largest airport are to be permanently eliminated.

There is currently no time horizon for when the change will take place. A representative of Skyalps told Südtiroler Rundfunk, among other things, that they had initially received promising booking numbers for winter 2021/22. Frankfurt: Verdi calls for a warning strike at Wisag

Just before Christmas, chaos is looming at Frankfurt Airport, as the Verdi union has called on employees of the ground handling company Wisag to stop work. The warning strike is scheduled to take place on Wednesday. Wisag holds around 15 percent of the handling volume at Germany's largest airport. This is not the first industrial action, as delays and cancellations occurred in October 2021 due to a warning strike. This time there will be no demonstration, as the Verdi union only wants to hold work stoppages in view of the current Corona situation. The fronts have been hardened between employee representatives and management for some time. The union wants working hours to be reduced to 37,5 hours and at the same time full wage compensation to be provided. The Wisag company considers the demands to be excessive and points out that it has offered 18 percent wage increases over a period of three years. The warning strike is considered irresponsible and inappropriate.
