ECJ: Short-term death of a pilot is not an exceptional circumstance

The European Court of Justice has ruled that the sudden death of a crew member does not constitute an extraordinary circumstance within the meaning of the Air Passenger Rights Regulation. Airlines are therefore liable for delays and cancellations. Under the case numbers C-156/22 to C-158/22, the European Court of Justice heard a case in which the co-pilot was found dead in his hotel room about two hours before departure on a flight from Stuttgart to Lisbon. Due to the tragic circumstances, the entire crew declared themselves unfit to fly for safety reasons. Tap had to cancel this flight and several others that were planned with this aircraft. A replacement aircraft and crew were flown in from Lisbon, but it did not take off from Stuttgart until 16:40 p.m. Several passengers assigned their passenger rights to service providers who went to court. The matter, which happened back in 2019, ended up before the European Supreme Court. The court is of the opinion that the short-term death of an indispensable crew member is not an exceptional circumstance, since another pilot could have taken over or another crew could have been deployed.

Budapest: Wizz Air and Mol test 37% SAF blend

Low-cost airline Wizzair and Hungarian oil company Mol are testing the supply of SAF fuels at Budapest Airport. These are made from vegetable oils, used cooking oils and animal fats, among others. The project supports the aviation industry's general efforts to reduce CO2 emissions throughout the entire life cycle and aims to prepare Budapest Airport's supply system for the introduction of the SAF blending requirement in 2025. On May 10, 2023, a 37% blend of Neste MY Sustainable Aviation Fuel supplied by Mol was used commercially for the first time. During the sustainable aviation fuel test, Wizz Air's three newest Airbus A321neo aircraft were equipped with a total of 23,5 tonnes of a blend of 37% pure SAF and 63% Jet A1 fuel. The aircraft carried passengers from Budapest to Stockholm, Paris and London using the sustainable fuel blend.

However, the company also came under criticism because the price level is sometimes extremely high. Air Baltic with new sales record in the first quarter of 2023

Latvian airline Air Baltic achieved revenues of EUR 105,1 million in the first quarter of the current year. This is not only 75 percent higher than the previous year, but also sets a new record for the first three months of a year. The number of passengers carried increased by 2022% compared to the first quarter of 77. Load factor reached 71,0%, an increase of 8,5 percentage points compared to 2019. In addition, the positive dynamics of the airline's business indicators led to a significant reduction in net profit, which fell threefold compared to 2022 to EUR -11,4 million, which is even better than Q1 2019 before the pandemic. "The first quarter of 2023 exceeded our expectations and led Air Baltic to strong commercial performance and sustainable profitability. Our clear goal is to achieve sales of 700 million euros and to significantly increase the number of passengers carried to 2023 million by the end of 4,4," says company boss Martin Gauss.
