Air Berlin: Flöther wants to sell Etihad claims

Some time ago, Air Berlin's insolvency administrator Lucas Flöther filed a claim for damages against Etihad Airways. The process has to be conducted in London and is apparently only progressing slowly. Now the lawyer wants to sell possible claims in the amount of at least 500 million euros.

According to the announcement, this is intended to speed up the process for creditors. Speculators could pay a certain sum to the bankruptcy estate and get the claim asserted against Etihad Airways assigned. This means that the litigation risk is passed on to the buyer.

In his function as insolvency administrator, Lucas Flöther is also bringing proceedings against former members of the Air Berlin board and their D&O insurance companies, as well as against the auditor KPMG. To what extent these proceeds will benefit the masses is still completely open. Recently it became known that against a subsidiary of Deutsche Börse AG was also taken to court.
