Based on a lawsuit brought by the low-cost airline Ryanair, the court of the European Union ruled that the loans approved by the EU Commission and granted to Air Europa by the Sepi state fund are legal. The verdict is not yet legally binding.
In the TAP and Air France-KLM cases, the same court ruled in favor of Ryanair, although these two judgments are not yet final either. The low-cost airline is suing almost all approvals for state aid from airlines. So far, apart from TAP and Air France-KLM, it has always been defeated.
It can be assumed that Ryanair will also appeal against Air Europa. So far, neither airline has commented on the decision of the Court of the European Union. In the event of an appeal, the case ends up before the ECJ.
