Germany has been carrying out border controls overland for several years under the guise of “refugees”. These are primarily limited to Austria. Actually, such exceptions from the Schengen Agreement should only exist for a maximum of six months, but the measure is constantly being extended.
A similar situation is evident in Austria on the borders with Slovenia and Hungary. There, too, checks have been carried out for a number of years, albeit only on a random basis. Now the EU Commission wants to regulate this issue anew and de facto legalize the procedure of various states.
In the future, the member states should notify the EU Commission if they want to carry out longer-term border controls and give precise reasons for this. Brussels can then make recommendations, but it is still not possible to prevent controls within the Schengen area. This is a reaction to a decision by the ECJ that classified the internal controls introduced by Austria on the border with Slovenia as illegal.
