Ischgl-Causa: OGH confirms lower courts

The Supreme Court has dismissed the lawsuits for official liability, supported by the consumer protection association, relating to the incidents in Ischgl in 2020 at the beginning of the corona pandemic and confirmed the judgments of the previous instances.

Peter Kolba is not at all satisfied with this and sees the fact that there is no preliminary decision at the ECJ as a reason for filing a state liability action. In its publication, the OGH does not take into account that the plaintiffs have also referred to the EU Charter of Fundamental Rights and that an interpretation by the European Court of Justice (ECJ) would be necessary, according to Kolba.

"This removal of victims from 45 nations is a deep disappointment for those who have suffered severe damage as a result of the mistakes made by the authorities in Tyrol. The verdict is a license for authorities, who can now do whatever nonsense they can think of during a pandemic. We will analyze the verdict in detail when we have the full text and are now considering taking action against the Republic of Austria with a state liability suit," explains VSV official Peter Kolba in a broadcast.
