The interpretation of the Schengen Agreement has been a chapter of its own, especially in Germany, since the beginning of the refugee crisis. During the corona pandemic, air traffic was often not checked at all and it was pointed out that this is not legally possible in the Schengen area. Now all flights are formally considered as “non-Schengen arrivals”. Domestic connections are excluded from this.
As a result, the federal police also carry out passport controls. At the same time, this should check the negative corona tests required for entry. According to the executive, the date of the smear is primarily taken into account. Furthermore, the data on the document is compared with that in the passport or identity card.
For months, Germany was criticized as a “loophole” because at most airports, passengers arriving from so-called risk areas were not checked at all. The consequences of this were that “disembarking cards” could be issued with fake data, but passengers could also conceal their real origin. For example, in Vienna it could be stated that one comes from Frankfurt.
The border controls now carried out by the federal police met with criticism again, because according to Bayerischer Rundfunk, numerous Mallorca returnees have complained about this measure. Without a negative test, you couldn't get on a plane at all. However, a “preliminary inspection” by the airline is not an official entry control. To make matters worse, the Spanish authorities have stopped a German doctor who is alleged to have issued certificates of convenience (PCR findings) for travelers. The doctor of German origin, who had an ordination in Mallorca, is accused of having issued negative PCR results without an examination. It is the presumption of innocence.
