Italy is once again one of the top travel destinations for summer holidays this year. However, the beautiful memories of past vacations fade away quickly when, years later, a request for additional toll payment ends up in the mailbox.

“The ÖAMTC legal advice is currently receiving many inquiries from club members about letters of demand from Italy. It is mostly about additional toll charges, which sometimes go back a very long time, sometimes as far back as 2015. In most cases, we still advise payment, since in Italy such claims only become statute-barred after ten years,” explains ÖAMTC lawyer Verena Pronebner.

How do the additional demands come about and what should be considered?

If you receive a letter from Italy, you should first check whether the claim is plausible - i.e. whether the specified time corresponds to the holiday in Italy. Then you try to find out the reason for the letter: If, for example, you are accused of speeding or entering a restricted traffic zone (zona a traffico limitato), then it is a police fine and you have to act quickly. This must be delivered within 360 days and you usually have the option of paying a reduced penalty amount within five days.

The currently frequent additional toll claims due to non-payment of the distance-dependent motorway fee are often sent by a collection agency. The amounts are between ten and 130 euros. “Many members believe that they paid the toll because the barrier opened and free passage was possible. However, the barriers open and allow drivers to pass, even if no toll amount has been deducted or the wrong lane (e.g. for Telepass holders) has been used. This is to prevent congestion on the freeway. Collection via debt collection agencies is also possible and common in Italy,” says the ÖAMTC lawyer. "So if you can't prove that the toll was paid years ago, you unfortunately have to make the payment now," says Pronebner.

Keep receipts and find out about toll costs in advance

In order not to be overwhelmed by a claim years later and to be able to prove payment, receipts should be kept. If you do not know what to do after receiving the request for payment or if you are overwhelmed with it, Club members can contact legal advice free of charge.
