The Austrian Social Democratic Business Federation (SWV) is calling on politicians to introduce a nationwide, uniform regulation for flat-rate tips. Current practice in Austria leads to considerable legal uncertainty and unfair competition for businesses, as the handling of flat-rate tips varies from state to state. SWV President Dr. Christoph Matznetter criticizes the "nine different tipping worlds" and calls for planning security for companies, especially in economically challenging times.
The varying regional regulations mean that companies often don't know exactly when and how the flat-rate tip allowance can be applied. This creates a situation in which a flat-rate allowance intended as a relief can become a "trap" if unexpected additional demands are subsequently made. Particularly problematic is that employers are held responsible for documenting tips, even though they go directly to employees and the exact amount is often known only to the recipients.
Günter Löffler, head of the tourism and leisure industry division at the SWV, emphasizes that a nationwide, uniform solution would not only clarify the legal situation but also strengthen competition in attracting skilled workers. The problem affects not only sectors such as the catering and hotel industry, but also personal services and the transportation sector. The SWV therefore calls for clarity and exemption from the comprehensive documentation requirement for companies to avoid unexpected additional demands for both businesses and employees.
The existing flat-rate regulations were developed at the time by the regional health insurance funds in cooperation with the Chamber of Commerce and with political approval. Dr. Christoph Matznetter points out in this context that those representatives now demanding exemption from taxes have supported and negotiated the current regulations for years. Legal certainty, transparency, and fairness for all parties involved are needed.
