BGH awards compensation for late connections outside the EU

The German Federal Court of Justice has decided that airlines are also obliged to pay compensation if the delay only occurs on a sub-segment outside the international community and is operated by another carrier.

What is decisive, however, is that it is a continuous booking that starts or ends in an EU country. The new BGH ruling does not apply to trips that you put together yourself, which include individual tickets for each flight segment.

The BGH found that it is relevant that it is a through booking of an airline that has issued a uniform ticket within the meaning of the EU Air Passenger Rights Regulation. If the delay then only occurs on a sub-segment outside the European Union or is caused by a non-EU partner airline, it is irrelevant according to the German Supreme Court. The Federal Court of Justice overturned the decisions of the two lower courts, which were of the opposite view.
