Air Berlin insolvency administrator Lucas Flöther has against the Deutsche Börse subsidiary Clearstream brought a lawsuit in the amount of 497,8 million euros. According to the lawyer, Brexit made this company a personally liable partner.
The former airline Air Berlin PLC & Co Luftverkehrs KG was organized as a limited partnership with a listed British stock corporation. Flöther takes the legal position that Brexit has resulted in the PLC in Germany becoming a company under civil law. The consequence of this should be that the shareholders are personally liable.
Clearstream explains to Handelsblatt that it had already examined this fact comprehensively before Brexit and that it does not believe that it has become the personally liable partner of Air Berlin. The lawsuit will be fought with legal means. The trial is being held before the Frankfurt am Main regional court.
