Germany declared Portugal a virus variant area on June 29, 2021, but downgraded it to a high-indication area on July 7, 2021. Anyone who entered exactly between the two deadlines had to be in quarantine for 14 days. A fully vaccinated woman did not want to put up with that and went to court.
The lady returned to Germany with proof of vaccination and a negative PCR test and was quarantined by the responsible health authorities for two weeks. In the case of virus variant areas, the Federal Republic of Germany does not provide for the possibility of free testing. But: If she had only stayed four days longer on the beach, she would not have received any segregation.
The competent administrative court for Frankfurt overturned the decision of the health department of the city of Frankfurt and lifted the quarantine as disproportionate. The fact that she would not have been segregated if she had only stayed four days longer in Madeira may have played a decisive role. The authority now has the opportunity to fight the decision before the Administrative Court in Kassel.
The German entry regulations that can be explained in more detail under this link, stipulate that everyone coming from so-called virus variant areas must be quarantined for 14 days. The vaccination status does not matter. Vaccinated people only have advantages if they come from non-risk areas, high-risk areas or high-incidence areas. In the specific case, it was a fully vaccinated woman who was also able to show a negative PCR test, which she obtained shortly before departure in Portugal.
