The restart of the revived airline Mexicana has been extremely bumpy so far. Now a lawsuit has been filed by a US leasing company. This is demanding around 840,9 million US dollars in court.

According to CH-Aviation.com, SAT Aero Holdings is to be commissioned to procure Boeing 737-800s, which will then be leased to Mexicana. However, there are said to be problems right from the start because the down payments that would have been made to the owners of the machines were not made. There are ten machines in total, but contracts with specific payment dates were allegedly signed for only two.

SAT should have flown the ten Boeing 737-800s for Mexicana under a wet lease agreement. However, this did not happen because, according to the plaintiff, the Mexican airline did not take care of numerous agreed points. At some point the contact is said to have been completely lost, so that they felt compelled to file a claim for damages.

At Mexicana you see the matter completely differently. It is alleged that SAT was unable to deliver the contractually agreed services in the form of wet lease with ten Boeing 737-800s. This would have had a negative impact on the start of operations of the new state carrier. It is believed that there are claims for damages against SAT. The Americans counter this by saying that Mexicana did not take care of permits and licenses and that this was the reason why they were not able to fly.

Ultimately, a court must decide who has to pay money to whom. The “new Mexicana” uses aircraft that were most recently operated by the military. The Embraer 145 is also in use as part of a wet lease agreement. According to Brazilian media reports, capacity utilization will continue to be rather modest.
